HELLMANN’S 2009 “IT’S TIME FOR REAL TASTE” CONTEST

THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW


1. HOW TO ENTER

A. NO PURCHASE NECESSARY. The contest begins on February 23, 2009 at 12:00:01 a.m. Eastern Time and ends on June 30, 2009 at 11:59:59 p.m. Eastern Time (the “Contest Period”). To enter the contest, purchase a specially marked 890ml Hellmann’s REAL mayonnaise jar. Complete the Taste Challenge attached to the jar. Go online to www.hellmanns.ca, enter your UPC code, all personal information as well as your guess as to which sample (labelled A and B) is Hellmann’s REAL Mayonnaise and which is Hellmann’s ½ the Fat mayonnaise-type dressing.

B. To receive an entry without purchase, mail in a piece of paper with your name, full mailing address, telephone number(s) and e-mail address (if applicable) in an envelope with sufficient postage to Hellmann’s “It’s Time for Real Taste” Contest to 207 Queens Quay West, Suite 500, Toronto, ON M5J 1A7, postmarked before June 15, 2009. You will be mailed back a valid UPC code as well as a Hellmann’s Taste Challenge kit. Complete the Taste Challenge and then go online to www.hellmanns.ca. Enter the UPC code provided, all personal information as well as your guess as to which sample (labelled A and B) is Hellmann’s REAL Mayonnaise and which is Hellmann’s ½ the Fat mayonnaise-type dressing.

Each person who enters online will receive one entry into the contest. Those who guess correctly will receive a bonus entry into the contest. All contest entries must be received within the Contest Period. All eligible entries received during the Contest Period will be entered in a random draw. Limit of one entry per person/home address/e-mail address per week of the Contest Period by any method. If it is discovered that you attempted to enter more than once per week, all of your entries will be VOID. Entries will be rejected if entry form is not fully completed and submitted during the Contest Period.

2. ELIGIBILITY

This contest is open to all residents of Canada who have reached the age of majority in their province or territory of residence at the time of entry except employees (and those with whom such employees are domiciled) or agents of Unilever Canada Inc. ( the “Sponsor”), its advertising and promotion agencies and the contest judges.

3. PRIZES

There will be three (3) Grand Prizes awarded, each consisting of a cheque written in the amount of CAD $10,000 for the selected winners. Prizes must be accepted as awarded and are not transferable. Prizes will be mailed to the winners’ homes. No substitutions except at Sponsor’s option. Sponsor reserves the right to substitute the prize or a prize component with one of equal or greater value.

4. DRAW AND WINNER SELECTION

On or about July 7, 2009 in Toronto, Ontario at approximately 2:00 p.m. Eastern Time, three (3) eligible entrants will be selected by random draw from all eligible entries received during the Contest Period. The odds of winning depend on the number of eligible entries received.  Selected entrant will be contacted by phone or email. If a selected entrant cannot be contacted within ten (10) business days of selection or there is a return of any prior notification as undeliverable, that entrant will be disqualified and an alternate entrant will be selected from among the remaining eligible entries. Before being declared a winner, the selected entrant must first: (a) correctly answer, unaided, a time-limited mathematical skill testing question to be administered by telephone at a prearranged mutually convenient time or e-mail; (b) sign a standard declaration and release form confirming compliance with the contest rules, acceptance of the prize as awarded and releasing the Sponsor, its advertising and promotion agencies, the contest judges and their respective officers, directors, agents, representatives, successors and assigns (the “Releasees”) from any liability in connection with this contest, the entrant’s participation therein and/or the awarding and use of the prize or any portion thereof.  If the selected entrant cannot be contacted by email or telephone or fails to return the contest documents within the specified time, he/she will forfeit the prize and an alternate eligible entrant will be selected. This process will be repeated until the prize is awarded.

5. GENERAL CONDITIONS

By entering the contest, the selected entrant agrees to the publication, reproduction and/or other use of his/her first name, city/town of residence, statements about the contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet. The Sponsor, its advertising and promotion agencies and the contest judges are not responsible for late, lost, misdirected, delayed or illegible entries.
Without limitation, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any failure of the web site during the contest; for any technical malfunction or other problems relating to the telephone network or lines, computer online systems, servers, access providers, computer equipment or software; for the failure of any entry to be received by the Sponsor, its advertising and promotion agencies or the contest judges for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any web site; or any combination of the above. Further, the Sponsor, its advertising and promotion agencies and the contest judges will not be liable for any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating or downloading any material in the contest.

The Sponsor reserves the right, subject to the approval of the Régie des alcools, des courses et des jeux (“the Régie”), to withdraw or amend this contest in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this contest as contemplated by these Rules. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

This contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law.  The decisions of the contest judges with respect to all aspects of this contest are final and binding on all entrants without right of appeal.

In the event of a dispute, online entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of an online entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry name change.

The sole determinant of the time for the purposes of a valid online entry in this contest will be the contest server machine(s).

The Sponsor, with the consent of the Régie, reserves the right to cancel or suspend this contest in the event of any accident, printing, administrative, or other error of any kind without prior notice or obligation. 

For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

By entering this contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the contest and in accordance with Sponsor’s Privacy Policy unless the entrant otherwise agrees.
